What action should I take to make my old employer pay me?

What action should I take to make my old employer pay me?

answers 0:I worked as a postdoc at a University until the middle of January. I am a legal alien here in the US and my SEVIS record has been changed to my new employer. Owing to a hiccup, for which I was not to blame, I wasn't paid for the last 2 weeks I worked. After weeks of unproductive communications, my old employer is giving me the run around about the funds being moved, my SEVIS being moved now making it illegal for them to pay me, and not making it clear how to reappoint me retroactively to pay me. Is there a government agency I can file suit against them for this, or any way to resolve this and make them pay me as I deserve? (Note: please don't suggest hiring a lawyer, I can't afford the dental work I desperately need because of this, so I certainly can't afford an employment/immigr! ation attorney!)...Show moreanswers 1:legal status has no bearing on wage claims (or any labor law) in the US.since you are here legally that is not a problem.....contact your states department of labor and file a wage claim. this won't cost you anything and they will assist you in getting your last pay.answers 2:There are a lot of agencies out there that will represent you pro bono for your immigration issues. If you are illegally living in a country, there isn't a government agency that won't report you to immigration if they find out you have overstayed your visa. Because you are living illegally in the country, and I assume where at the time of the work you were doing, meaning you were also illegally working in the country, you have very little chance of getting it back.answers 3:Just to clarify, I am here legally. I was legal then and I am legal now. What is illegal (according to them), is that they feel they can't pay me anymore because my SEVIS record has been moved ! to my new employer. However, I would argue that it is illegal ! not to pay employees!!
