Hilde Heskett: It can only be patented if it is a player VS dealer game and NOT a player vs. player game. The game needs to have an original playing surface (i.e. table) and a NEW game dynamic which can be represented by the card/winning hands/betting structure. I don't know exactly how you would patent this but check out the us patent office @ http://www.uspto.gov/ . The reason I'm sure of this is because of the casino games Casino War, Three Card Poker, and WPT Poker. Which casinos have to pay fees to have in their house because they are OWNED by private companies the most notable being SHUFFLEMASTER (who's website is shufflemaster.com).
